Digital Millennium Copyright Act (DMCA) Compliance
OrcusPrep respects intellectual property rights and complies with the Digital Millennium Copyright Act. We respond promptly to valid infringement notices.
Copyright Infringement Reporting
If you believe your copyrighted work has been reproduced or distributed on OrcusPrep in a way that constitutes copyright infringement, please notify our designated Copyright Agent with the following required information:
Required Information for Valid DMCA Notice:
- Authorization: Physical or electronic signature of the copyright owner or authorized representative
- Work Identification: Detailed description of the copyrighted work claimed to be infringed
- Infringement Location: Specific identification of the infringing material and its exact location on our platform (provide complete URLs)
- Contact Details: Your full contact information including address, telephone number, and valid email address
- Good Faith Statement: Statement that you have a good faith belief the disputed use is not authorized by the copyright owner, its agent, or the law
- Accuracy Statement: Statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner
Legal Warning: Knowingly misrepresenting that material is infringing may subject you to liability for damages, including costs and attorneys' fees under Section 512(f) of the DMCA.
Counter-Notification Procedure
If you believe your content was removed in error or misidentification, you may submit a counter-notification containing:
- Your physical or electronic signature
- Identification of the removed material and its location before removal
- Statement under penalty of perjury that you believe the material was removed by mistake
- Your name, address, telephone number, and consent to local federal court jurisdiction
- Statement that you will accept service of process from the person who filed the original DMCA notice
Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, OrcusPrep has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. We may also limit access to the platform and/or terminate the accounts of any users who infringe any intellectual property rights of others.
Educational Content and Fair Use
OrcusPrep primarily hosts educational content that may include:
- Original educational materials created by our team specifically for NEET/JEE preparation
- User-generated educational content shared for academic purposes
- Limited portions of copyrighted materials used under educational fair use doctrine
- Open educational resources (OER) with appropriate licensing
- Creative Commons licensed content with proper attribution
- Public domain educational materials adapted for exam preparation
Content Removal Process
Upon receiving a valid DMCA notice, we will:
- Promptly acknowledge receipt of your notice
- Remove or disable access to the allegedly infringing material
- Notify the content provider of the removal
- Provide the content provider with your contact information
- Follow DMCA procedures for counter-notifications if applicable
Third-Party Content Responsibility
OrcusPrep may contain user-generated content, embedded educational resources, and community contributions. While we make efforts to ensure compliance, we cannot monitor all content. We rely on copyright owners to report potential infringements.
